§ Website and Service Terms and Conditions

Nihongo no Kai website (“Website”) and related services (together with the Website, the “Service”) are operated by Nihongo no Kai, Ltd. (“us,” or “we”). Access and use of the Service is subject to the following Terms and Conditions of Service (“Terms and Conditions”). By accessing or using any part of the Service, you represent that you have read, understood, and agree to be bound by these Terms and Conditions including any future modifications. Nihongo no Kai may amend, update or change these Terms and Conditions. If we do this, we will post a notice that we have made changes to these Terms and Conditions on the Website for at least 7 days after the changes are posted and will indicate at the bottom of the Terms and Conditions the date these terms were last revised. Any revisions to these Terms and Conditions will become effective the earlier of (i) the end of such 7-day period or (ii) the first time you access or use the Service after such changes. If you do not agree to abide by these Terms and Conditions, you are not authorized to use, access or participate in the Service.

§ Description of Website and Service

The Service allows users to (i) learn or practice a language. Users interested in learning or practicing a language are presented with different types of educational activities including interacting with the other users. Nihongo no Kai, in its sole discretion and at any time, update, change, suspend, make improvements to or discontinue any aspect of the Service, temporarily or permanently.

§ Registration

In connection with registering for and using the Service, you agree to provide accurate requested information about you and to maintain the confidentiality of your password and other information related to the security of your account.

§ User License

a. Permission is granted to temporarily download one copy of the materials (information or software) on the Website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • • modify or copy the materials;
  • • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • • attempt to decompile or reverse engineer any software contained on Company's web site;
  • • remove any copyright or other proprietary notations from the materials; or
  • • transfer the materials to another person or 'mirror' the materials on any other server.

b. This license will terminate if you violate any of these restrictions and my be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

§ Disclaimer

Any dispute that arises between Users using the Service will be resolved between the relevant Users and Nihongo no Kai will not be liable therefor.

If any User infringes on the rights of a third party (defamation of a third party, infringing on the privacy rights of a third party, disclosing any personal information of a third party without permission, violating the Copyright Act or the like), the User shall resolve the infringement at its own responsibility and expense and Nihongo no Kai will not be liable therefor.

Nihongo no Kai, Ltd. will not be liable for any direct or indirect damage incurred by any User or a third party due to loss or divulging of data, or use of data for a purpose for which the Service is not intended, by the User.

Nihongo no Kai, Ltd. will not be liable for any damage incurred by any User or a third party due to delay, suspension, amendment, termination, registration, or prohibition or suspension of use of the Service license shall automatically terminate if you violate any of these restrictions and may be terminated unless any wilful misconduct or gross negligence of Nihongo no Kai, Ltd. is confirmed.

Nihongo no Kai, Ltd. will not be liable for any indirect, incidental, punitive or consequential damage caused in connection with the Service (including, without limitation, delay, failure or suspension of the Service)
